Information obligation of the operator (for web portal) according to Art. 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter "the Regulation") in accordance with § 19 of Act no. 18/2018 Coll. on Personal Data Protection (hereinafter referred to as the “Act”).

II.

The data subjects may address their comments and requests concerning the processing of personal data to the controller, in writing or in person at the address of the establishment: Gorkého 1, Humenné 066 01.

III.

The operator processes personal data for the following purposes:

a / Processing of personal data necessary for the performance of the contract
b / Processing of personal data within the payroll and personnel agenda
c / Processing of personal data with the consent of the data subject

Operator information service (for web portal) according to Art. 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council on individuals with regard to the processing of personal data and on the free movement of data (hereinafter "the Regulation") with § 19 of Act no. 18/2018 Coll. (see only "law").

IV.

The processing time of personal data for individual purposes is determined to the extent of:

a / 10 years of processing of personal data according to par. III. letter a).
b / 10 years of processing of personal data according to par. III. letter b).
c / the time necessary to fulfill the purpose, or mutually agreed upon processing of personal data pursuant to para. III. letter c).

V.

The personal data obtained will be processed in their entirety by the operator.

The source of the data is, unless otherwise stated, the records pursuant to a special law or the person concerned who provided his personal data to the operator.

VI.

Processing of personal data according to par. III letter a) is required according to a special regulation (Civil Code, Commercial Code, etc.) and at the same time to conclude a contract. If the data subject does not provide his personal data, it is not possible to conclude a contract.

Processing of personal data according to par. III letter b) it is necessary according to a special regulation (eg wage regulations - labor code, social insurance law, tax laws, etc.)

Processing of personal data according to par. III letter (c) is possible only with the consent of the person concerned.

Basic rights of the person concerned:

  • Right to withdraw consent
  • Right of access to personal data
  • Right to rectification and erasure (forgetting) of personal data
  • Right to restrict the processing of personal data
  • Right to portability of personal data
  • Right to object to the processing of personal data
  • Right to apply for personal data protection proceedings

On the individual rights of the person concerned:


THE RIGHT OF ACCESS TO PERSONAL DATA

The data subject has the right to request information from the controller concerning his personal data, namely the purpose of the processing, the categories of personal data concerned, the recipients or categories of recipients (to whom the personal data were or will be provided), the retention period, the right to request the controller to correct or delete or restrict the processing of personal data concerning the data subject; against such processing, the right to complain to the supervisory authority, the provision of information on the existence of automated decision-making, including profiling, including the right not to be subject to a decision based solely on automated processing, including profiling, which has legal effects concerning them or similarly significantly affect it. The data shall be provided free of charge electronically, unless the data subject requests otherwise; the operator may charge for additional copies a reasonable fee corresponding to the administrative costs.
 


ON THE RIGHT TO CORRECT AND DELETE ("FORGETTING") PERSONAL DATA

The data subject has the right to correct incorrect personal data concerning him or her, as well as the right to supplement incomplete personal data, including by providing a supplementary declaration. The data subject shall have the right to obtain from the controller, without undue delay, the erasure of personal data concerning him or her if one of the following reasons is met:

  • personal data are no longer needed for the purposes for which they were obtained or otherwise processed,
  • the data subject withdraws the consent on the basis of which the processing is carried out (legal basis under Article 6 (1) (a) or Article. 9 par. 2 letter a) of the General Regulation on Data Protection (§ 13 par. 1 letter a) or Art. 16 par. 2 letter a) of Act no. 18/2018 Coll., And if there is no other legal reason for processing),
  • the data subject objects to the processing under Art. 21 par. 1, par. 2 of the General Data Protection Regulation,
  • personal data were processed illegally,
  • personal data must be deleted in order to comply with a legal obligation under Union or Member State law to which the controller is subject,
  • personal data were obtained in connection with the offer of information society services according to Art. 8 par. 1 of the General Regulation on Data Protection (Section 15, Paragraph 1 of Act No. 18/2018 Coll.).

In case of publication of data, the operator shall ensure their deletion with regard to the available technology.


ON THE RIGHT TO RESTRICT THE PROCESSING OF PERSONAL DATA

The data subject has the right to restrict processing if:

  • challenges the accuracy of personal data,
  • the processing is illegal and the data subject objects to the deletion of the personal data and calls instead for a restriction on their use,
  • the controller no longer needs personal data for processing purposes, but the data subject needs them to prove, assert or defend legal claims,
  • or objected to the processing under Art. 21 par. 1 of the Regulation until it is verified that the legitimate reasons on the part of the operator outweigh the legitimate reasons of the person concerned
     

THE RIGHT TO THE TRANSFER OF PERSONAL DATA

The data subject shall have the right at any time to obtain personal data concerning him which he has provided to the controller in a structured, commonly used and machine-readable format and shall have the right to transfer such data to another controller without his controller to whom the personal data were defended. processing is based on the consent of Art. 6 par. 1 letter a) or Art. 9 par. 2 letter a) of the General Regulation on Data Protection (§ 13 par. 1 letter a) or Art. 16 par. 2 letter a) of Act no. 18/2018 Coll. or contractually according to Art. 6 par. 1 letter b) of the General Regulation on Data Protection (§ 13 paragraph 1 letter b) of Act No. 18/2018 Coll.), And processing is performed by automated means. The data subject shall have the right to transfer personal data directly from one controller to another, as far as is technically possible, without prejudice to the rights and freedoms of others.


RIGHT TO OBJECT AGAINST THE PROCESSING OF PERSONAL DATA

The data subject has the right at any time, for reasons relating to his specific situation, to object to the processing if the personal data are processed on the basis of Art. 6 par. 1 letter e) or f) of the General Regulation on Data Protection (§ 13 paragraph 1 letter a) or f) of Act no. 18/2018 Coll.), Including the objection of profiling (processing in the public interest, for the purposes of legitimate interests). The data subject has the right, if personal data are processed for the purposes of direct marketing, the data subject has the right at any time to object to the processing of personal data concerning him for the purposes of such marketing, including profiling to the extent related to such direct marketing.

The data subject may also exercise his right to object to the processing of personal data by automated means using technical specifications. The notification shall include a clear and simple description of the nature of the personal data breach and a description of the likely consequences of the personal data breach, the measures taken or proposed by the controller to remedy the personal data breach and the contact details.
